G birdday bash

This year, my birdday falls on the second day of CNY…. and sometime, having birdday around festive season is not a good idea. But I cant do anything on it. Maybe you can ask my parents.

I won’t have my szer and homies to celebrate with………………..hhmmm. Well, birdday is just another day. Seriously, I forgot what it was like to be a birdday boy and blow candles. The recent candle blowing was Kyra’s. The important things is not the cake but the person who is so dear and my homies. Anyway, I’ll just compensate with the Gs I stocked in my fridge for CNY. I’ll only have the old comrades, the Gs and small cousins, aunties, uncles, granny and mom to celebrate birdday. Guess it’ll be ok.

However, because it falls on CNY, I can’t really go anywhere and relatives will be here in KL and hopefully I can get double angpaus from everyone. For both CNY and birdday. Haha. *sinister grin*.

I’m not writing this in advance for whatever reason. Ok. Just run out of things to write lately.

Liability Insurance

Types of liability insurance:

1. Employer’s liability - The Employer’s Liability (Compulsory) Act 1969 requires all employers carrying on business in Great Britain to insure against their legal liability for injury or disease caused to their employees in the course of their work for them. So, for the liabilities that employers may incur in respect of their employees, cover is usually arranged under the employer’s liability insurance section of a package or combined policy.

2. Public liability – Public liability insurance protects the insured in respect of legal liability to third parties for both bodily injury and for any loss of or damage to material property that the insured may be held responsible for. Members of the public may suffer injury or damage to their property due to the activities of someone else, and public liability insurance has been designed to provide compensation for those who may have to pay damages and legal costs for such injuries or for the damages to property.

3. Products liability – Product liability insurance provides coverage to the insured’s legal liability for bodily injury to third parties or loss of or damage to material property caused by products or goods, a cover which is usually excluded from public liability insurances. Products liability insurance is frequently combined with public liability insurance to avoid any potential gaps in insurance cover. All types of businesses involved in the supply of goods, products or services are likely to be in need of product liability cove e.g. manufacturing, retailing, wholesaling, installation, maintenance, repair or servicing.

4. Professional indemnity – Professional people (accountants, solicitors, architects, doctors, surgeons etc) can insure their special liabilities on a professional indemnity insurance to cover the consequences of, for example, giving faulty advice or treatment.

5. Directors’ and officers’ liability – The senior officers of companies have statutory duties and the consequences of failing to comply with these duties can be insured by directors’ and officers’ liability insurance.

6. Libel and slender – Newspapers and similar publications can protect against the results of their words by having a libel and slender insurance.

7. Environmental liability – The cleaning up of pollution and contamination under the requirements of the Environment Act 1995 can be insured against by environmental liability insurance.

8. Retrospective cover – To resolve the difficulty of untraced policies, or policies with may have had restrictive endorsements, some insurers are prepared to issue a retrospective policy or one with retrospective cover.

9. Legal costs and expenses – There are areas of business life in which a person or company may be faced with legal expenses unconnected with any liability policy. Some or all of these legal expenses can be insured separately on a legal costs and expenses insurance.

10. Financial loss – Circumstances may arise where a claim made against the insured is not dependent upon injury to third parties or damage to property, but is purely for financial or economic loss. Financial loss cover is for the insured’s legal liability for damages and costs and expenses incurred in respect of a financial loss.

11. Products guarantee – This insurance deals with the exclusion, under products liability cover, of the cost of repairing or replacing the defective product. The aim is to protect the insured against their legal liability arising out of the failure of their products to fulfill their intended function.

In relation to employer’s liability, the factors that would be taken in assessing and rating the risk are:-

  • the type of business;
  • the categories of employees showing separately, for example:
  • - clerical,
  • - managerial employees not engaged in manual work,
  • - manual work,
  • - manual work using power driven machinery,
  • - labour only sub-contractors,
  • - principals and partners,
  • - and all other employees;
  • the number of employees and annual wage roll for each category
  • specific details of work carried out away from the insured’s premises and any work carried out outside the UK;
  • use or past use of hazardous materials, e.g. acids, chemicals, gases, asbestos or explosives;
  • guarding and maintenance of machinery and plant;
  • any work undertaken at height or below ground;
  • any high risk activities e.g. steeplejacks, stuntmen etc.
  • compliance with statutory requirements for health and safety and other applicable legislation.

2. The steps taken in doing liability surveys are as follows:-

  • Visiting the Insured’s premises;
  • Evaluating and estimating the likely frequency and severity of the liability risks taking into account the employers, public and products liability exposures;
  • Verifying the information provided on the proposal regarding business activities, working practices, health and safety, quality control etc.

The considerations that would be taken by the surveyor in doing liability are:-

  1. health and safety policy and attitude;
  2. risk assessments carried out for manual handling, safe systems of working, display screen equipment etc;
  3. training and supervision of staff;
  4. machinery and plant condition, maintenance, safety guards and protections;
  5. transportation on the premises;
  6. provision and use of personal protective equipment;
  7. occupational health and welfare assessment, e.g. noise levels, first-aid provision;
  8. public access and controls;
  9. use and control of contractors;
  10. pollution risk;
  11. work away from the insured’s own premises – activities and locations;
  12. product risk exposure, quality assurance and export details.

(a) Retrospective cover:

To resolve the difficulty of untraced policies, or policies which may have had restrictive endorsement, some insurers are now prepared to issue a retroactive policy or one with retrospective cover. These are issued on the “claim made” basis. This means that the insurers are liable for claims made during the year of insurance even if the events have occurred in the past.

The retroactive policy will exclude any risk for which a more specific insurances was in force, and also where an indemnity under a previous policy was not available because of a breach of policy conditions, non-disclosure or misrepresentation.

(b) Directors and officers liability:

Over the last ten years or so company directors and their senior employees have been found to be personally responsible for their negligence in the running of their company. Legislation has also made company directors liable for the behaviour of the company so that shareholders, creditors, customers, employees and others can now sue the directors as individuals.

The policy provide an indemnity to the company in respect of the costs it incurs in indemnifying a director against the successful defence of a claim and an indemnity to the director in circumstances where this cannot be obtained from the company because the defence has not been successful.

Liability may arise out of lack of care and skill in the performance of the duties; for example, negligent advice or mis-statement, particularly in the context of a merger or takeover when failure to understand economic trends results in a poor forecast of the company’s performance. Any act which goes beyond the company’s constitution such as excessive borrowing, unauthorised payments, failure to disclose the full extent of the directors’ interests or a failure to comply with requirements may involve a director or office in a personal liability. Failure to arrange proper insurance may also attract liability.

Directors’ and officers’ liability policies exclude:

  • claims for bodily injury or damage;
  • actions brought against an individual director as a result of their own dishonesty, fraudulent or malicious conduct;
  • claims arising from improper personal gain, profit or advantage;
  • breaches of professional duty.

(c) Environmental liability:

The standard liability cover excludes pollution and contamination unless caused by a sudden identifiable, unintended unexpected incident that takes place in its entirety at a specific time and place during the period of insurance.

Section 57 of the Environment Act 1995 imposed statutory duties on local authorities to inspect its area to identify contaminated land and decide if land is to be designated a special site. It also promoted the principle that the polluter pays for the clean up costs.

Liability for cleaning up land designated “ a special site” rests with the appropriate person who may be the original polluter, the party knowingly permitting the polluting or the innocent buyer or occupier.

The liability is retroactive so it requires the clean up of historic pollution. There is no cut off date. Those likely to be at risk are:

  1. property owners or prospective property owners;
  2. agricultural land owners;
  3. motor traders;
  4. financial institutions (lending money for the purchase of land or property)
  5. factories and businesses involved in the production or supply of chemicals.

This liability cover is very specialised and available only from a few insurers. Before contemplating the provision of such covers very rigorous checks and detailed surveys will be undertaken of the land and/or property in question. Even if an insurer is prepared to provide such cover it can be extremely expensive when compared to normal liability insurance cover.

Compressor oil

After the new year ration shopping in hometown, I went to service my car aircond and was burned a hole in my pocket. However… it is worth the money if it can provide me a fridge-like in-car environment.

No matter what car you drive, an old junk or a sports car, the most important thing is the air conditioning. In our hot weather, nothing is more important. The first compressor jammed, then the second one was fixed by a stupid mechanic and it ruined the system.

Ok. Only send your car to a specialist aircond shop for all things air conditioning. Seriously. Normal mechanics will give you shitty air cond job and cost you a compressor or more.

Everytime they change a compressor for you, make sure they clean the pipings with petrol in order to clean all the dirt or residue that may be clogged in the pipes. This will ensure a cleaner system. Now I learned something. Seeing is believing when the aircond guy explained to me what happened in the system and when he took out the faulty compressor and showed me the black dirt that clogged it…. I now understand..

Yay.

shopping on thaipusam day

The most rightfully declared holiday for KL, the Thaipusam day was not wasted by most city dweller. 1U car parks were full. Went into its basement carpark and jammed for 15-20 minutes and came out of it. It was madness at 2.18pm. Went to the Curve and walked around for CNY clothes. Bought some tshirts and shirt. I’m a bit choosy in clothes nowadays. Not like last time, whatever that serves the purpose of wearing a shirt is alright.

Ok…I’ve learn something  that day. I didn’t know there’s such technology of a belt buckle that can be twisted. So, the belt can be used both side. I mean, let say, dark brown on one side and black on the other. Very interesting, my dear.

Fitness centre at Hartamas

Ok… again I was lured by a marketing ploy. A friend referred me to the sales guy and was called by him that he’s giving me a 7-days trial at True Fitness. Ng was supposed to go with me but last minute he couldn’t make it. Went there alone to see what’s the deal.

Its just like those hotel people who’s trying to push for time-sharing vacation club membership packages. They want to know what credit card you have, why are you here etc. Then, they give you a one night complimentary room stay.

Luckily the sales guys is someone who dont give a fuck. He even tried to pakat with me on how to tackle his manager’s problem. He know I’m there just for the free trial and not interested at all. He just don’t want people to waste money if they are not really into workout. He told me that the prices on the brochure can go way lower and I’m on my own to ward off his manager’s marketing push. Man, it was hilarious…. some ladies will do a lot of thing to sell a product. The sales guy just sat there quietly and at times send Morse code to me by blinking his eyes. Prices can cut down to 50%. Joining fees and registration fees can be waived.

Well, the place and atmosphere is nice. Anyway, I’ve just sold some of you readers’ contact number to them for a water flask and calculator. Sorry.

Where are you going this CNY?

Had lunch with colleagues and asked them where they are going this coming CNY. I fella’s gf’s a sabahan and I asked him if he’s going over to sabah for CNY and guess what he said. NOPE. He said nope. He just said not interested to go. I was like…

its CNY…. ok fine maybe the airfare is super expensive he wanna save and go after CNY. Whatever the reason…. what I’m more interested here is that the other 2 of us kept asking him why he’s not going and he said its not the airfare or money problem. We even told him to at least you see them once a year during CNY. Not that we’re asking him to go there every month.

Then he said one thing….. “you all afraid you won’t see them (the family) when (or if) you’re married later on?”.

What the fuck, geez… basket, how can I respect someone who fucking said that?

Thaipusam is a holy day for KL !!

Prime Minister Datuk Seri Abdullah Ahmad Badawi announced that Thaipusam holiday is extended to Federal Territory of Kuala Lumpur and Putrajaya. So, this coming Wednesday (23rd Jan) is a holiday for KL. Wooohooo.

Ok… it is a public holy day thus it should be a public holiday too. Sometime we wonder why it was not a public holiday in the first place.

Get your diary and check how many public holidays are there for the Indian Hindus in the calendar as compared to other race/religion? Any other Hindu’s public holiday for all states? Please let me know.

Thanks to our PM for declaring it…. but why not a public holiday like Wesak Day for all 14 states in Malaysia? Some states have no Hindus? Hmm…

Fidelity Guarantee

Fidelity Guarantees insurance relate to situations where employees handle their employer’s money or other property

  • Handling cash as a cashier or sales assistant does; or
  • Being involved in record keeping, in the way that an accountant, computer operator or other property manager does

Employee can divert employer’s money or property to somewhere (employee’s own pocket/account). This can go unnoticed for a long time and can involve substantial amounts of money. Money policy does cover limited theft by employee but it has to be discovered within 24 hours.

 

FG policy involves 3 parties:-

  1. The insurer
  2. The insured (the employer)
  3. The applicant or insured person whose fidelity is guaranteed

 

Insurer becomes a guarantor in respect of the insured person. If the insured person commits a fraud against the employer, the guarantor make payment. Some employees may be required to obtain a `guarantee’ as a condition of their employment, example:-

  • Stewards in clubs, commercial travelers, collectors, public house managers, bus drivers, cashiers, checkout operators, sales assistants, treasurers

These people work independently collecting employer’s money and are subject to temptation. Examples of employees who do not handle cash but are still able to commit fraud and will be able to divert money or property to their own use are:-

  • Book keepers, accountants, procurement and store officials, computer programmers, computer operators, directors and managers

because these employees have access to the systems operated by employees and they can manipulate these for own gain. They can divert large amounts of money at one go or small amounts over a long period.
The cover applies during:-

  • The currency of the policy
  • During the `discovery period’ – a period during which theft committed during the currency of the policy and discovered 24 months after termination of the policy, or the guilty party resigns , leaves the employment or dies

The cover will indemnify the insured in respect of loss of money or other goods and property caused by the fraud or dishonesty of the insured person. Cover will often include:-

  • Auditor’s fees incurred in substantiating the amount of loss
  • The cost of rewriting or amending computer programmes to avoid further losses

Policy may cover fraud committed before policy commenced but not discovered until the policy operates. If there has been continuous FG policy the loss is covered. Even if the risk is transferred from one insurer to another the benefit is not lost. The fraud must be discovered outside the discovery period of of the superseded policy. Existing insurer may cancel out the discovery period but the new policy will have the `interlocking’ provision. FG policies may be subject to an excess or deductible.

There are a few types of fidelity policy:

a) Named employee basis
- Policy is on a named basis with a limit per named person
- Deals with individual employees holding specific position

b) Blanket policy basis
- covering all employees in a specific department or specific jobs without naming employees
- Is suitable where the jobholders keep changing from time to time.
- the rate will be determined by the amount of money passing through these department
- policy will have limit of indemnity any one loss and an aggregate limit over all losses

c) Position basis
- usually arranged by local authorities which guarantees the holders of specified positions within the authority
- these are often called government bonds
- they tend to cover mistakes as well as dishonesty

In rating and underwriting the risk, there are 2 factors to be considered:

a) Employee
- background of the employee with confirmation from previous employers
- a form is used to get this confirmation from the previous employer
- new employers are now required to get written reference from the past three years employers and to pay special attention to apparent gaps in employment
- reference may have to be produced in the event of a claim
- if there is no reference obtained the limit of indemnity will be reduced say to about 10%
- Employee’s financial background:

 

  • insured person’s financial situation is also of importance
  • this will help detect any potential future dishonesty
  • if there is large debts, big mortgage and no savings, heavy family commitment, there is a chance of temptation

b) Employer’s responsibilities (these are what Mr John will have to take into account to enjoy lower premium rates)
- insurers do not dictate to employers on how their system should work
- in the proposal form, insurers will find out the checks built into the systems to prevent fraud
- if these check have flaws, these should be put right
- these improvements may become warranties or endorsements on the policy to ensure that the improved state of affairs continues
- breaches may happened and cover of up to 5% excess is available for inadvertent breaches

- For previous losses

  • insurer will want to know if there have been previous losses
  • insurer will examine reason for such losses and the actions taken to prevent recurrences

- Recruitment Policy

  • insurer will want to know how thoroughly the employer investigates the background of the potential employees
  • suitable checking procedure should be in place

c) Other considerations

- The policy carries 2 particular conditions:-

  • first it will be a condition precedent to any claim that any dishonest employee be prosecuted
  • The second feature relates to the rights of subrogation, whereby:-
    • the employer will be indemnified and
    • the insurers will retain the right to attempt recovery of their outlay from the wrongdoer.

- Computer Fraud

  • it is possible for outsiders to electronically extract funds from a company or its accounts
  • agency and consultant staff can also be dishonest
  • this risk can be covered by an extension to the FG policy covering computer fraud by non-employees

My buddy’s first life accomplishment

Congrats to Yea Chern who is now legally a husband. I was at Thean Hou Temple in the morning with Lee, Wen Shing and her sister the personality cum makeup artist. Of course, the family members of both the groom and bride were there too. I was there because he’s one of my best buddy and Lee and I were the cameramen. Well, I missed Ng’s and Towkay’s, I don’t wanna miss this because I don’t know who will be the next… how soon will it be. Lee, everyone’s looking at you. Hehehehe.

The whole session was quick. In less than 5 minutes for signing papers, taking oath and exchanging rings, it was over. The guy administering the affair talk like a preprogrammed voice recording machine in fast forwarding mode. After that, the whole morning was spent taking pictures at various places around the temple vicinity. There were many middle eastern tourists which came by the bus loads. They were amazed at seeing my friend and his wife and almost everyone whipped out their cameras to take pictures of Yea Chern’s wife. Everyone.

Congrats bro. Treat your wife right. Hope I can be godfather soon, ok.

Found this at Giant supermarket in Cheras. The boxed package is expensive and only have  around 15-20 pieces of biscuits. But this one in a bigger container and its just RM13.90. I’m hooked to this one. Yummy.

Today’s Star paper greeted me this morning with “Medium who wanted sex”. Man, just can’t believe why the victims, the ladies, can get conned into having sex. Getting conned of money and valuables is normal and its all because of greed. But… sex… because of what? Just dont understand. This is not the first time such a thing happened.

I remember getting conned by 2 annehs who came knocking my friends apartment house and asked for donation. They said they were sent by god to our place and thats fate. They said they will give us two 4-digit numbers in return for donation of 120 something ringgit. We… my friend, his mom and myself, gathered the amount and they performed a “ritual” whereby real one of them appeared to be like being possessed by a medium and the other was like an assistant, wiping the dripping blood from the possessed man’s mouth and holding him from going gaga swinging his hands and legs and jumping around. That bugger already bit/cut his tongue and we were stunned by the blood and thought it was a real thing… thats where we were conned. Then, the part where the possessed guy wrote the number was arrghh… blood dripped onto the paper.

The possessed guy said only buy Pan Malaysian Pool Horse Race (now known as damacai) for a certain amount of ringgit. Not more or less. I can’t remember how much was it now. After the show, they requested for fresh milk to stop the bleeding and I went and bought a pack of fresh milk. The mamak saw I went and bought milk and gave it to the conmen and fucked me why I give money to the conmen. Only then I reallised… but we were so naive back then.

It was greed that got us getting conned….. looking back, that was many many years ago. Geez… the real bleeding show is still vivid in my memory.

So…folks, take care of yourself and don’t get conned.

Bloodstock insurance

Bloodstock insurance provide cover for most animals such as horses, dogs, cats, sheep, cattle etc. Insurance is available on a commercial basis as well as on an individual basis (single animal).

The risk is usually split to stallions/bulls and mares as well as follows:

  • risk for stallions/bulls relates mainly to their infertility

  • in relation to mares, risk relates to pregnancy and birth issues

  • animals under package policies will have risks relating to accident, injury, sickness and disease

The aim of the cover is to compensate the owner in respect of service fees lost due to the stallion/bulls infertility.

  • In respect of young stallions, cover is for risk of partial servicing success being achieved (due to animal’s lower level of fertility)

  • in respect of mares, cover will provide compensation for mortality during birth, barrenness and unborn foals

Extension is available for surgery costs and expenses. Short period cover for transit is also provided. These risks can apply to many other valuable animals.

Package cover will include:-

  • all risks or mortality including theft, arising from accident, sickness and disease

  • surgical extension is available up to a certain limit

  • permanent loss of use

  • vet’s fees

With an additional premium, the optional package cover will include:-

  1. saddlery and tack

  2. legal liability

  3. personal accident

In rating the risk, the insurer will generally interested with the following information:

  • age

  • breed

  • use

  • value

  • health record

  • claims experience (if any)

These are also considered important as underwriting factors:

Stallions

  • sire

  • dam

  • service season

  • service fee

  • service record

  • no foal no fee basis

Mares

  • date due to give birth

  • fee paid for covering

  • year animal last gave birth

  • any foals aborted or stillborn

Animal above a certain value or with a poor claims history, a veterinary certificate or x-rays may be required. For racing or show animals, career winnings will be taken into account plus the activities undertaken i,e flat racer, hurdler, steeple chaser etc.

The majority of rating factor will include:

  1. animal’s value

  2. service fees

  3. saddlery and tack value

  4. personal accident benefits

  5. limits of liability

  6. activities undertaken by the animal

  7. age of the animal

  8. claims experience and animal’s health record

A number of insurers provide package policies for individual animals. Only a few insurers offer bloodstock insurance for valuable animals.

Protonic holiday

Test was over and its been sometime I had something so intensified. Its kinda good as you know your limit and that’ll push you further. Life nowadays revolves around that one and only text book and notes and the internet of course.

Found a nice place to hang out… a place where there’s not much traffic and provide ample parking and yet tranquil in a sense of that its a new housing area/township. No wonder Towkay said the place is so nice. Went there this morning with mom for a wind eating ride and its really a nice place… and of course the price is nice too. A cheapest unit cost around RM930K. There’s a Jusco supermarket, bank, shops etc over there. Kluang Station, Secret Recipe…. all there. Its a very nice place.

Towkay is gonna be promoted to Daddy soon. LouSai become LouTau. Thats a life accomplishment everyone is looking for. Another homie is tying the knot soon… yes… Yea Chern. See the Announcement section above.

This afternoon was spent yamcha with Yea Chern in Kepong and he only found out that his car’s fuel pump was malfunction after I left the place. So I went back to the yamcha place to assist him. Went around to look for a mechanic at 6.38pm and most of the workshops were closed at that time. Luckily theres one still open and we had no choice but to pay for it. A few hundred bucks just to change the fuel pump.

And thanks to the Proton Gen 2 fuel tank supplier’s precision, it took the mechanic 1 hour plus to fucking take the pump out from the fuel tank…. after scheming and hammering the hole. Had the diameter of the hole been a milimeter wider, it would’ve been just a few minutes for the whole ordeal. Maybe the fuel pump’s precision was compromised. And we did all that in front of the Kopi Street white coffee joint.. near the snow beer shop.

Ok… that was awal muharam holiday.
